This legal document incorporates the confirmed operating model of Mecano911 / Mobile Mechanics: mobile mechanic dispatch, both direct and independent mechanic arrangements, upfront disclosed call-out fees when a customer declines repair, customer payment, Montréal-area coverage, and full compliance with Québec's Consumer Protection Act (mandatory written estimates, authorization of additional work, and the 3-month / 5,000 km statutory warranty).
TERMS AND CONDITIONS OF SERVICE
Purpose and Scope
These Terms and Conditions govern the use of Mecano911.com and the mobile automotive services arranged or provided through Mecano911.
Mecano911 facilitates the dispatch of a mechanic to a customer's vehicle location within its service area. Depending on the booking, the mechanic may be employed by, contracted by, or independently affiliated with Mecano911.
Services may include mechanical diagnostics, maintenance, repairs, and certain emergency automotive services, subject to availability, the nature of the vehicle problem, and the equipment and parts available at the service location.
The specific services, price, applicable fees, expected arrival window, payment arrangements, and identity of the contracting service provider will be communicated to the customer as applicable before the customer commits to the booking.
These Terms must be read together with the specific booking confirmation, accepted repair estimate, and any applicable service-specific conditions. In the event of a conflict, applicable mandatory law prevails.
Acceptance of the Terms
By submitting a booking request, accepting a service offer, or authorizing work, the customer agrees to the applicable terms disclosed for that transaction.
Mecano911 will make these Terms available before the customer commits to a booking. Where required, the customer will receive a copy of the applicable contract and other required documents.
Nothing in these Terms waives or restricts a consumer's mandatory rights under Québec or Canadian law.
How Mecano911 Works
The customer submits a request for automotive assistance and provides the vehicle's location and relevant information about the problem.
Mecano911 reviews the request and, if service is available, arranges for a mechanic to travel to the vehicle.
The mechanic assesses the situation and determines whether the requested work can reasonably and safely be performed at the location.
Depending on the circumstances, the mechanic may provide a diagnosis, a written repair estimate, an explanation of the available options, and a proposal for the work required.
The customer may accept or decline the proposed repairs, subject to applicable law and any lawful, separately disclosed fee for dispatch, travel, or diagnostic services already provided or incurred.
A request for assistance does not guarantee that the vehicle can be repaired on-site or that the reported problem can be resolved during a single visit.
Contracting Party and Mechanic Relationship
Mecano911 uses more than one service arrangement.
4.1 Direct or contracted service
For certain bookings, Mecano911 may contract with the customer to arrange or provide the automotive service and may fulfil its obligations through a mechanic employed by or contracted to Mecano911.
Where Mecano911 is the contracting merchant responsible for the repair, it remains responsible for the obligations imposed on it by applicable law, including obligations that apply to work performed by a subcontractor.
4.2 Independent service provider
For other bookings, the customer may contract directly with an independently operating mechanic or automotive service business introduced or coordinated through Mecano911.
Where this arrangement applies, the booking confirmation will identify the independent service provider and explain the respective roles of that provider and Mecano911.
The independent provider is responsible for the obligations imposed on it by law and under its agreement with the customer. Mecano911 remains responsible for its own contractual, statutory, and other legal obligations.
4.3 Disclosure before booking
Before the customer commits to a booking, Mecano911 will identify the contracting service provider, explain the applicable payment arrangement, and disclose any relevant distinction between Mecano911's role and the mechanic's role.
The contracting arrangement will not be determined retroactively after a dispute arises.
Nothing in this section automatically excludes Mecano911's responsibility for a mechanic, contractor, or subcontractor where applicable law imposes that responsibility.
Service Area and Availability
Mecano911's primary service area is Montréal and the surrounding areas specifically included in its published coverage or confirmed for the booking.
Service availability depends on the customer's precise location, mechanic availability, traffic, weather, the nature of the problem, and the availability of appropriate tools and parts.
Requests outside the normal service area may be declined or accepted subject to a separately disclosed travel charge.
A booking confirmation will identify the applicable service location and any additional travel charges.
Mecano911 may be unable to dispatch a mechanic to restricted-access locations, unsafe roadside locations, private property without permission, or locations where the mechanic cannot safely perform the requested service.
Scheduled and Emergency Services
Mecano911 offers both scheduled appointments and emergency or urgent dispatch, subject to actual availability.
Emergency or urgent service does not necessarily mean immediate service or guaranteed 24-hour availability. Any published operating hours, response-time commitments, or emergency service guarantees will apply only as expressly stated.
An estimated arrival time is not a guaranteed arrival time unless Mecano911 expressly confirms a guarantee in writing.
Traffic, weather, previous service calls, road closures, vehicle complications, parts availability, and other circumstances may cause delays.
Mecano911 will make reasonable efforts to communicate material delays and available alternatives.
Customer Information and Access
The customer must provide accurate information reasonably necessary to dispatch a mechanic and assess the service request.
This includes, where applicable:
- The customer's name and contact details.
- The vehicle's make, model, year, and registration or VIN number.
- The vehicle's precise location and parking details.
- A description of the symptoms, warning lights, or suspected problem.
- Any known safety hazards, access restrictions, or relevant vehicle conditions.
Pricing and Disclosure of Fees
The customer will be informed of the applicable charges before committing to the booking.
Depending on the service, charges may include:
- A dispatch or call-out booking fee.
- A travel or service-area surcharge if applicable.
- A diagnostic or inspection fee.
- Labour charges (billed in 15-minute increments after the 1-hour minimum).
- Replacement parts, fluids, and supplies (with transparent quoting and markup).
- Applicable Québec GST (5%) and QST (9.975%) taxes.
- Other specifically disclosed and authorized charges.
Call-Out Fee When the Customer Declines Repairs
If a mechanic travels to the vehicle and the customer decides not to proceed with the proposed repair, the customer may be required to pay the previously disclosed call-out, travel, or diagnostic fee applicable to the booking.
Before confirming the appointment, Mecano911 will disclose: the exact applicable fee or the method used to calculate it; what the fee covers; whether it remains payable if the customer declines the repair; whether a separate diagnostic charge applies; and any circumstances in which the fee may be waived or refunded.
The customer will not be charged an undisclosed refusal fee or an arbitrary penalty for declining a repair.
The call-out fee does not authorize the mechanic to perform repairs without the customer's approval.
Any fee charged must comply with Québec consumer-protection law, the agreed transaction, and the rules governing repair estimates and the condition in which the vehicle must be returned.
If the mechanic cannot perform the service for reasons attributable to Mecano911 or the assigned service provider, any fee or refund will be assessed under the applicable booking terms and law.
Additional Repairs and Changes in Scope
A mechanic may discover additional defects or complications during a repair.
If additional work is required, the mechanic will explain the findings, the proposed work, and the associated charges.
The mechanic must obtain the customer's express authorization before carrying out additional repairs where required by law. Any revised estimate or authorization will be documented in accordance with applicable requirements.
The customer is not required to authorize additional work merely because the mechanic has arrived or has begun an authorized diagnostic service.
If the customer declines the additional work, the mechanic will explain any reasonable next steps and comply with applicable obligations concerning the vehicle and previously authorized work.
Parts and Materials
Parts and materials required for repairs will be identified and charged in accordance with the accepted estimate and applicable law.
The customer will be informed whether relevant replacement parts are new, used, retooled, or reconditioned, as required.
Parts availability may affect the time needed to complete a repair. If a required part is unavailable, the customer will be informed of the options, which may include rescheduling or arranging another repair location.
Any applicable manufacturer's warranty, parts warranty, or additional commercial guarantee will be communicated to the customer.
Statutory rights and guarantees are not replaced or reduced by a manufacturer's or supplier's warranty.
Payment and Invoicing
The customer is responsible for paying the lawful amounts due under the applicable booking and accepted repair estimate.
The customer will be informed before committing to the booking whether payment is made directly to the mechanic or service provider or through Mecano911.
Where the customer pays the mechanic or independent service provider directly, that provider is responsible for issuing the invoice and processing payment for the services it supplies, subject to the applicable legal arrangement.
Where Mecano911 collects payment, Mecano911 will issue or arrange the required invoice and handle payment in accordance with the applicable transaction.
The invoice must accurately identify the responsible merchant and include the information required by law, including the repairs performed, applicable parts and charges, labour information, taxes, total amount due, and warranty information where required.
Customers should retain their booking confirmation, accepted estimate, invoice, and proof of payment.
Cancellation and Rescheduling
Customers should contact Mecano911 as soon as possible to cancel or reschedule an appointment.
Any cancellation deadline or fee will be disclosed before the customer commits to the booking.
A cancellation fee may be charged only where it is supported by the agreed terms and applicable law. It must not be used to defeat a statutory cancellation right.
If a mechanic has already been dispatched, the applicable disclosed call-out or travel fee may remain payable where legally permitted and consistent with the booking terms.
If Mecano911 or the assigned mechanic cancels or cannot provide the confirmed service, the customer will be informed as soon as reasonably practicable and offered an appropriate alternative, rescheduling, or refund where applicable.
Refunds and cancellation rights will be determined in accordance with the transaction, the services actually provided, and applicable law.
Vehicle Safety and Limitations of On-Site Repairs
Not every mechanical issue can be repaired safely or completely at the vehicle's location.
The mechanic may determine that a vehicle requires workshop equipment, a hoist, specialist diagnostic equipment, additional parts, or towing to a suitable facility.
The mechanic may refuse or stop work where the location or circumstances present an unreasonable safety risk.
Where reasonably practicable, the mechanic will explain the issue and recommend an appropriate next step.
Mecano911 does not guarantee that every reported problem will be resolved during the initial visit or that a vehicle will be safe to drive merely because a particular repair has been completed.
The customer should not operate a vehicle where doing so would present a known and material safety risk.
Any towing or additional service arranged at the customer's request will be subject to its own applicable terms and disclosed charges.
Repair Quality and Statutory Warranties
Repairs must be performed in accordance with the accepted estimate and applicable legal requirements.
Québec's Consumer Protection Act provides a statutory guarantee for covered automobile repairs of three months or 5,000 kilometres, whichever occurs first, subject to the Act and its exceptions.
The guarantee begins upon delivery of the automobile following the repair. The statutory guarantee does not cover damage resulting from abuse by the consumer after the repairs, as provided by law.
Where the repair is subject to the statutory guarantee, the responsible merchant must honour the customer's rights under that guarantee.
Any additional commercial warranty will be described separately, including its duration, scope, and claims procedure.
Customers who believe that a repair was defective should contact the responsible merchant promptly, provide the invoice and describe the issue, and allow the complaint to be assessed in accordance with applicable law.
Acceptance of an estimate or payment does not eliminate statutory remedies for unauthorized repairs, defective workmanship, or unlawful charges.
Responsibility for Vehicle Damage and Loss
Mecano911, the contracting repair merchant, and the assigned mechanic are responsible for their respective acts and omissions to the extent required by law and the applicable contractual arrangement.
A customer's vehicle may have pre-existing defects, corrosion, hidden damage, or prior improper repairs. Such conditions may affect the outcome of the work.
Responsibility for damage will be determined based on the facts, the work authorized, the conduct of the parties, and applicable law.
Nothing in these Terms automatically excludes responsibility for damage caused by negligent or otherwise legally actionable conduct.
Nothing in these Terms excludes liability for fraud, intentional misconduct, gross fault, or any other liability that cannot lawfully be excluded.
Any claim for vehicle damage should be reported promptly to the responsible merchant or service provider with the booking reference, invoice, and available supporting information.
Independent Mechanics and Service Providers
Where an independent mechanic or automotive business contracts directly with the customer, the booking confirmation will identify that provider and explain the respective contractual responsibilities.
The independent provider is responsible for its own services and obligations to the extent provided by law.
Mecano911 remains responsible for its own representations, booking activities, contractual commitments, and other obligations imposed by law.
Where Mecano911 itself contracts with the customer for repairs, using an independent mechanic or subcontractor does not, by itself, eliminate Mecano911's obligations as the contracting merchant.
The actual arrangement for each booking, rather than a general label, determines the applicable contractual and statutory responsibilities.
Privacy and Personal Information
Mecano911 will handle personal information in accordance with applicable privacy legislation, including Québec's private-sector privacy requirements (Law 25) where applicable.
Information may be collected to process requests, dispatch mechanics, communicate with customers, arrange payment, issue invoices, manage complaints, and meet legal obligations.
Information will be disclosed to mechanics, service providers, payment processors, and other recipients only as permitted by law and for appropriate purposes.
Customers may consult the Mecano911 Privacy Policy for further information about collection, use, disclosure, retention, safeguards, and applicable privacy rights.

Website Use and Communications
Customers must use Mecano911.com lawfully and provide accurate information when submitting service requests.
Customers must not use the website to submit fraudulent requests, interfere with its operation, obtain unauthorized access to systems, or misuse another person's personal information.
Mecano911 may send communications necessary to process a booking, confirm an appointment, coordinate dispatch, provide updates, issue invoices, or respond to complaints.
Marketing communications will be handled in accordance with applicable consent and privacy requirements.
Delays and Events Beyond Reasonable Control
Severe weather, traffic disruptions, road closures, emergencies, unexpected parts shortages, and other circumstances beyond reasonable control may affect service availability or arrival times.
Mecano911 will make reasonable efforts to notify affected customers and discuss available alternatives.
This section does not automatically excuse non-performance where the law provides otherwise, nor does it eliminate any refund, cancellation, or other mandatory consumer right.
Complaints and Customer Support
Customers may contact Mecano911 regarding booking issues, charges, delays, service quality, or other concerns.
A complaint should include the customer's name, booking reference, vehicle information, service date, and a description of the issue.
Mecano911 will review the complaint and, where appropriate, refer it to the responsible repair merchant or service provider.
Customers retain all complaint, mediation, consumer-protection, and legal remedies available under applicable law.
Changes to These Terms
Mecano911 may update these Terms and Conditions from time to time.
The version applicable to a booking will be identified or made available when the customer commits to the transaction.
Changes will not retroactively remove rights or alter an existing agreement contrary to applicable law.
Where fresh consent is legally required, it will be obtained before the amended terms apply to the relevant transaction.
Governing Law and Disputes
These Terms and Conditions are governed by the laws of Québec and the applicable laws of Canada.
Any dispute will be addressed by the competent court or authority in accordance with applicable law, including mandatory rules governing consumer contracts and jurisdiction.
Nothing in these Terms requires a consumer to waive a right or remedy that cannot legally be waived.
Severability
If a provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The invalid provision will be interpreted or limited only to the extent necessary to comply with applicable law.
